The Mburubu General Assembly has appealed the Enugu State High Court's decision to order a fresh election for the traditional rulership of the community, citing the ruling as unjust and a disregard for the community's traditions.

The Mburubu General Assembly has announced its appeal against the Enugu State High Court 's ruling that ordered a fresh election for the traditional rulership of the community. An Enugu State High Court nullified the election held to replace the deceased monarch on Wednesday. However, Barr. Chijioke Odueze, the assembly's counsel, described the ruling as surprising and unjust to the people's will, speaking to journalists in Enugu on Friday.

He pointed out the court's acknowledgement of both the 1976 and 2003 community constitutions, yet disregarding the former in favor of the latter, calling it an astonishing travesty of justice.Odueze revealed that the group had filed a stay of execution of the judgment pending their appeal. He explained that several individuals contested the traditional leadership of Mburubu, currently held by Chief Jerry Patrick Onuokaibe. The matter was scheduled for judgment on February 12th, where the trial judge, Hon. Justice Egbe, ordered a fresh election and the use of the 2003 constitution, an unknown document to most. Odueze confirmed the filing of a notice of appeal, expressing confidence that the appellate court would ensure justice prevails. A stay of execution was filed immediately, in line with legal requirements, alongside the notice of appeal. All relevant parties, including the Attorney General of Enugu State and the Enugu State Ministry of Local Government, Chieftaincy, and Rural Development (respondents 4 and 5), were served.He emphasized that the 1976 constitution remained the only recognized and widely accepted document guiding Mburubu's traditional leadership structure. This was the same constitution under which the late Igwe, HRH Igwe EMO. Ezeh, was elected and enthroned without dispute. Imposing an unfamiliar document on the people at this juncture is illogical, he noted. He warned that any attempt to enforce the judgment without completing all legal processes would be a direct affront to the community's customs and traditions. The assembly is determined to see this matter through to a just and logical conclusion, confident that the appellate court will not allow this injustice to stand. Meanwhile, the Ndị Nze na Ọzọ Mburubu and Ákwá Mburubu, the highest traditional groups in the community, have strongly condemned the judgment, affirming the 1976 constitution as the legally recognized framework for kingship selection. They maintain that it was under this same constitution that the late Igwe, HRH Igwe EMO. Ezeh, was rightfully enthroned. The judgment left the community in shock and distress, with many expressing concerns over what they perceive as an attempt to undermine their long-standing traditions. However, the situation was calmed by Igwe-elect, Igwe Dr. Jerry Patrick Onuokaibe, who reassured the people of a just resolution
