Mr.
Rotimi Jacobs , who helped the Economic and Financial Crimes Commission to secure the conviction of former Governor, of Abia State, Orji Kalu, has said the Supreme Court’s order for a fresh trial will be obeyed.
Jacobs, who prosecuted Kalu for 12 years on behalf of the EFCC, said the Supreme Court judgement would be complied with since it is the highest court in the land.on Friday, Jacobs said, “The Supreme Court ordered that the case should return to trial. So, we will obey the court judgement. We are not deterred by what has happened. We will continue to fight on.
In the course of the trial, the prosecution counsel, Rotimi Jacobs, SAN, called 19 witnesses and tendered several documents that were admitted in evidence by the court. On Friday, however, the Supreme Court ruled that Justice Idris had no power to hear Kalu’s case as he had already been elevated to the Appeal Court and thus could not sit in two courts at the same time.
The Supreme Court subsequently nullified a section of the Administration of Criminal Justice Act which gives the Appeal Court President the power to give newly elevated judges the power to conclude their old cases at the high court.DOWNLOAD THE PUNCH NEWS APP NOW ON
