The Supreme Court of Nigeria has ruled in favor of Senator Samuel Anyanwu, confirming his position as the legitimate National Secretary of the Peoples Democratic Party (PDP). The court overturned lower court rulings that had removed Anyanwu and installed Sunday Udey-Okoye as his replacement.
The Supreme Court of Nigeria has made a significant ruling in favor of Senator Samuel Anyanwu , officially recognizing him as the legitimate National Secretary of the Peoples Democratic Party ( PDP ). A five-member panel of justices, headed by Justice Uwani Abba-Aji, overturned the December 20, 2024, judgment of the Court of Appeal in Enugu. This earlier judgment had upheld a High Court decision that removed Anyanwu from his position and installed Sunday Udey-Okoye as his replacement.
Dissatisfied with the appellate court's decision, Anyanwu appealed to the Supreme Court, arguing that both the Court of Appeal and the Enugu High Court lacked the authority to adjudicate on matters concerning the internal workings of the PDP. He firmly maintained that leadership and membership disputes within a political party are not issues for the courts to decide. Anyanwu also criticized the lower courts for failing to ascertain whether the plaintiff in the case had exhausted the PDP's internal mechanisms for resolving disputes before going to court. He further questioned the courts' decision to grant the plaintiff the standing to challenge his position as National Secretary, emphasizing that such matters are fundamental to a court's jurisdiction. Anyanwu also contested the lower courts' interpretation of Section 84(12) of the Electoral Act 2022, asserting that neither he had resigned nor had he been legally removed from office. He stressed that the PDP's constitution clearly outlines the procedures for removing executive positions, and there was no legal basis for the courts' findings that he had vacated his office. He emphasized that Article 47 of the PDP constitution stipulates a single four-year term for party officers, further bolstering his claim that his removal was unlawful.
