A legal dispute has erupted between the Osun State Government and the All Progressives Congress (APC) regarding the interpretation of a Court of Appeal ruling that overturned the nullification of the 2022 local government elections. The APC asserts the ruling reinstated the elected chairmen, while the state government maintains the court did not make such an order.

The legal battle between the Osun State Government and the All Progressives Congress ( APC ) continues over the interpretation of a Court of Appeal ruling concerning the removal of local government chairmen. The dispute revolves around the recent judgment in Akure regarding the validity of the 2022 local government elections in Osun State . The APC National Secretary, Dr.

Ajibola Basiru, a former Attorney General and Commissioner for Justice in the state, criticized the state government's stance, arguing that it undermined the rule of law. Basiru stated that the state government's misrepresentation of the court's judgment was an affront to the legal system and suggested that they were condoning illegality. He emphasized that a court judgment carries a presumption of validity and bindingness until overturned, and the only legal recourse for a dissatisfied party is to appeal to the Supreme Court. He clarified that neither Alimi nor the Osun State Government could overrule the Court of Appeal's decision. Basiru highlighted that the Court of Appeal's judgment considered all grounds of appeal raised against the Federal High Court's ruling, which had nullified the local government elections and ordered the elected officials to vacate office. He noted that the Court of Appeal's decision allowed all the APC's reliefs, including setting aside the Federal High Court's judgment and ordering the reinstatement of the sacked local government councils. However, the Attorney-General and Commissioner for Justice in Osun State, Jimi Bada, maintained that the court did not reinstate the sacked chairmen. He clarified that the ruling primarily addressed the case filed by the Action Peoples Party (APP), which challenged the election's validity. According to DAILY POST, political parties and stakeholders have engaged in heated exchanges following the judgment, with the APC asserting that the court's decision restored the elected chairmen to their positions, while the PDP and the state government argued otherwise. The Osun State Independent Electoral Commission, responsible for conducting the election, is also involved in the dispute. During a press briefing on Tuesday, the Attorney-General reiterated that the court did not order the reinstatement of the sacked officials, emphasizing that the ruling, which nullified the election in response to the APP's case, affected all parties involved. He stated that the Court of Appeal did not make any statement regarding the reinstatement of sacked local government chairmen. The legal uncertainty has fueled further political tension in Osun, with both parties standing firm on their interpretations. APC supporters have called for the immediate reinstatement of the sacked chairmen, while PDP loyalists insist the ruling favored the state government's position
