Aloy Ejimakor, special counsel for the detained leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu has expressed hope that the Federal High Court in Umuahia, Abia, will deliver judgement in the extraordinary rendition suit filed by Kanu. Ejimakor said the suit would not be affected by the recent Appeal Court ruling in favour of Kanu. According to him, the Federal High Court in Abia will sit on October 27 to judge Kanu’s case. A three-member panel of the Court of Appeal in Abuja last Thursday, struck out all charges against the IPOB leader.

Judgment On IPOB Leader, Nnamdi Kanu’s Fundamental Rights Suit Before Abia High Court Not Affected By Appeal Court Ruling, To Hold October 27 – LawyerEjimakor said the suit would not be affected by the recent Appeal Court ruling in favour of Kanu.

The court held that Kanu’s extradition from Kenya in June 2021 to Nigeria without following the extradition rules was a flagrant violation of Nigeria’s extradition treaty and a breach of the IPOB leader’s fundamental human rights. “The inquiries are apparently necessitated by the judgment of the Court of Appeal in Abuja on 13th October. Despite this Court of Appeal judgment, the Federal High Court, Umuahia will still proceed with its own judgment on 27th October, 2022 as was previously scheduled. My office has not received, and we do not expect to receive any notice from the court that the judgment has been adjourned.

“For ease of reference, I will reproduce below the prayers pending before Umuahia and which were not specifically and fundamentally considered or captured by the judgment in Abuja. They are: “4, A DECLARATION that any criminal prosecution of the Applicant the purpose of which the Respondents unlawfully expelled the Applicant from Kenya to Nigeria is illegal, unlawful, unconstitutional and amounts to infringement of the Applicant's fundamental right to fair hearing, as enshrined and guaranteed under the pertinent provisions of CFRN and the Charter.
