When the case came up for hearing, Police Prosecuting Officer, Sergeant Friday Kanshio, told the court that on June 1, 2020, one Josephine Habba of 34 Modern Market Road, Makurdi, reported at the Nigerian Police Force ‘D’ Division that she saw one Mrs Favour Emeka crying and telling a nurse at Jestic Hospital, Makurdi, that her husband raped her seven months old daughter.

The police prosecutor told the court that Habba reported that Favour had taken the baby to the hospital for treatment. According to Kanshio, the police arrested the accused in the course of investigations, saying the offence was contrary to Section 391 and 284 of the Penal Code, Benue State. He said investigations into the matter was still on and asked the court for another date for continuation of trial. The accused pleaded not guilty to the charge. The trial Magistrate, Isaac Ajim, remanded the accused at the Nigerian Correctional Service Centre and adjourned the case to August 31, 2020.
