Nnamdi Kanu , the leader of the outlawed IPOB , vowed to challenge the Court of Appeal judgment. Aloy Ejimakor, Kanu's special counsel, stated in a statement on Friday night that Kanu made this declaration during a visit by him and his legal team to the IPOB leader at the State Security Service facility.

IPOB is a group advocating for an independent state of Biafra, seeking to carve it out from the Southeast and parts of the South-South Nigeria. The Nigerian government, under President Muhammadu Buhari's administration, proscribed the separatist group in 2017. \Speaking through Ejimakor, Kanu argued that the judgment affirming IPOB's proscription was flawed. He asserted that the ruling would be met with vigorous resistance within the bounds of both domestic and international law. Kanu believes the judgment failed to meet the standards set by the Nigerian Constitution and relevant statutes. Ejimakor explained that a key argument presented to the appeal court was that the Federal High Court's 2017 proscription order was obtained through an ex parte application by the federal government, rather than a hearing with notice attended by a judge. \They also argued that the proscription proceedings violated the fundamental principle of fair hearing enshrined in the Nigerian Constitution. They contend that IPOB was neither informed nor given a chance to be heard before the proscription order was granted. Ejimakor further argued that the proscription directive issued to the Attorney General was signed by the late Chief of Staff, Abba Kyari, not then-President Buhari, as stipulated by law. The Court of Appeal acknowledged these procedural shortcomings but ultimately dismissed their appeal, citing national security as an exception to constitutional provisions. Ejimakor questioned the perceived national security risk posed by IPOB in 2017 that warranted such a blatant breach of the Constitution, which he argued disproportionately targeted the Igbo people. He emphasized that the Constitution mandates a strict adherence to a specific process before any provision can be suspended in the name of national security.
