The Court of Appeal in Abuja dismissed PDP’s suit against the nomination of Messrs Tinubu and Shettima as presidential candidates and running mate, respectively.
The party had urged the Court of Appeal in Abuja to hold that the APC’s presidential candidate, Mr Tinubu, and his running mate, Kashim Shettima, were not qualified to run for the election.
A three-member panel headed by James Abundaga, in a unanimous judgment, held that the PDP failed to establish that it had the locus standi to institute the case. “The appellant, having failed to disclose its locus standi, this appeal fails and it is hereby dismissed,” he said and proceeded to affirm the judgment of the FHC.The News Agency of Nigeria reports that the PDP, in an appeal marked: CA/ABJ/CV/108/2023, had prayed the appellate court to reverse the 13 January judgment delivered by Inyang Ekwo of the Federal High Court, Abuja, which dismissed its suit on the grounds that the PDP lacked locus standi to have instituted the suit.
It argued that Mr Shettima’s nomination as the running mate was in breach of the provisions of Sections 29, 33, 35 and 84{1)}} of the Electoral Act, 2022 , claiming that he had double nominations.
