A former Minister of Power and Steel, Dr Olu Agunloye, has vowed to appeal the ruling of a Federal Capital Territory (FCT) High Court in Apo, which dismissed his preliminary objection challenging the powers of the Economic and Financial Crimes Commission (EFCC) to prosecute him.
A former Minister of Power and Steel, Dr Olu Agunloye , has vowed to appeal the ruling of a Federal Capital Territory High Court in Apo, which dismissed his preliminary objection challenging the powers of the Economic and Financial Crimes Commission to prosecute him.
“The alleged offences in this charge bother on my activities as a public officer, on the alleged award of contract without budgetary provision, approval and cash backing. In his affidavits, Agunloye added that “this is a threshold issue, in which I know that the court must first satisfy itself that there are requisite statutory powers in the EFCC to prosecute this charge, and competent jurisdiction in the court to entertain same.”
Consequently, the former minister is praying the court for an order “prohibiting the EFCC, whether by itself or any officer within its employ, from prosecuting or further prosecuting the instant charge against the defendant, for lack of both investigative and prosecutorial powers under Sections 6, 7 & 46 of the Economic and Financial Crimes Commission Act, 2004.”Before flagging, please keep in mind that Disqus does not moderate communities.
